1. Overview

Please read this agreement carefully before accessing or using the information and services available through the Future Campus website (“Site”). By accessing or using the Site, you agree to be bound by the terms and conditions below. Future Campus may modify this agreement at any time, and such modifications shall be effective immediately upon posting the modified agreement on the Site. Future Campus also has a comprehensive privacy policy for users of the Site.

The Site is owned and operated by Future Campus Pty Ltd (ABN 44668678135) defined as (“Future Campus”, “we”, “us” and “our”).

Your continued use of this Site will be deemed as acceptance of these Terms by you.

2. Information for personal, non-commercial use only

You agree that information contained on this Site is for personal use only and may not be sold, redistributed, or used for any commercial purpose. You may download material from this Site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.

You may not use data mining, robots, screen scraping, or similar automated data gathering, extraction or publication tools on this Site (including without limitation for the purposes of establishing, maintaining, advancing, or reproducing information contained on our Site on your own website or in any other publication), except with our prior written consent.

3. Publication and Advertising Terms of Use

These terms and conditions (“Terms”) govern all Publicists and Advertisers (defined as “Publisher”, “Advertiser”, “you” and “your”) that:

  • have an advertisement or publication on www.futurecampus.com.au.
  • have an advertisement or publication in Future Campus’s The Digest newsletter.
  • have utilised any features of the Site or Future Campus’s products offered through the Site.

Your access to and use of the information, materials and services provided on this Site is conditional upon your acceptance and compliance with the Terms.

4. Limitation of Liability and Disclaimer

Future Campus does not investigate or endorse any person, company or organisation that uses, advertises, posts on or provides Material to the Site or any events, information, products or services (“Products“) offered for sale or otherwise identified or provided by them. The availability of Material through the Site does not constitute advice about the appropriateness, value or suitability of any Material or Product, any particular transaction or course of action nor does it constitute any recommendation or endorsement by Future Campus of any Product or to you to enter into any transaction or follow any course of action. Any decision that you make about any Material or Products offered, identified or provided through the Site or referred to or advertised on the Site must be based solely on your own evaluation of your circumstances and objectives and of the Material or Product. Future Campus recommends that you independently verify the accuracy, currency or reliability of any Material made available via the Site and upon which you intend to rely.

Future Campus provides no warranty to you that services generally available through the Site will be uninterrupted or error free. Except where we are unable to exclude our liability by legislation, we, our officers, employees, agents and contractors will not be liable in any way to you or anyone else for any loss or damage, however it arises (whether in contract, tort including negligence, or otherwise) out of or in connection with your access and use of the Site.

In the case of goods or services supplied or offered via the Site, Future Campus’s liability for breach of a term (whether implied or otherwise) which cannot be excluded by legislation, is limited at our option to either, the supply of the goods or services (or the equivalent goods or services) again or the payment of the cost of having the goods or services supplied again.

Our limitation of liability under these Terms applies to direct, indirect, consequential, special, punitive or other damages that you or others may suffer, as well as damages for loss of profit, business interruption or the loss of data or information, even if we are informed of their possibility.

Future Campus accepts no responsibility or liability for any errors in your publications or advertisements and you must check your publications or advertisements for errors as soon as they are placed on the Site.

Future Campus agrees to use reasonable efforts to publish publications and advertisements in the shortest possible time.

Future Campus cannot and does not guarantee or warrant to the you that files available for downloading through the Site or delivered via electronic mail through the Site, or features and products available through the Site, will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

5. Changes to the Site

Future Campus reserves the right at all times without the need to have to provide any notice to you, to alter the functionality and/or appearance of its products and services available from Future Campus or the Site itself, including but not limited to advertisements on the Site and/or as they are represented on mobile communication devices. In doing so, we will endeavour to consider exceptionally detrimental consequences such alterations may cause you.

 

6. General Terms

Future Campus reserves the right to terminate your agreement with us if you utilise any feature of the Site or Future Campus Product in any way which is in breach of any of these Terms or the Product Terms.

Future Campus reserves the right to, in its absolute discretion (acting reasonably), reject, edit or remove any content, publications and advertisements from the Site for any reason.

Termination of our agreement with you as a result of you breaching any one or more of these Terms, will not end provisions of these Terms that are capable of surviving termination.

Any clause within these Terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of these Terms is not affected.

These Terms are governed by the laws of Victoria. Users irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of Victoria, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.

By subscribing to Future Campus, you consent to receive information and/or promotional material from us.

7. Intellectual Property

You acknowledge that copyright, trademarks, and all other intellectual property rights (“IP Rights”) in the Site and in the Material displayed or available through the Site belongs to Future Campus or its licensors.

You are provided access to the Site only for your personal use. Subject to applicable laws:

  1. unauthorised use of the Material is strictly prohibited and may infringe Future Campus’s or its licensors IP Rights in the Material; and
  2. no content may be reproduced, published, or transmitted in any manner without the prior written consent of Future Campus.

Without limiting the above, and subject to applicable law, you may not without prior written permission from Future Campus

  • archive the Material or any part of it;
  • form a database whether electronically or otherwise by systematically downloading or storing all or any of the Material;
  • redistribute or republish the Material; or
  • link to the Site including (without limitation) linking in any way which:
    • frames the Site;
    • replicates the Site; or
    • misleads any person regarding any association with the Site or any association with Future Campus (whether implicitly or expressly).
